SHIPPING, RETURN AND REFUND POLICY – USwapX

1. PURPOSE

This policy sets out the conditions for shipping, delivery, returns, and refunds applicable to transactions carried out on the USwapX platform. 

USwapX is a platform that connects individuals (and, where applicable, associations or businesses) wishing to sell or rent second-hand items. The conditions below apply to all site users. 

2. SHIPPING METHODS

An item may be shipped in two ways: 

  • Directly by the seller or lessor, in agreement with the buyer or renter. 
  • Via the shipping service offered by USwapX, if this option is activated. 

Shipping costs are borne by the buyer or renter, unless otherwise stated in the listing or agreed upon separately. Delivery times are specified before order confirmation and may vary depending on the location of the parties and the chosen shipping method. 

3. MAXIMUM SHIPPING TIME

The seller or lessor has a maximum of 5 business days after order confirmation to proceed with shipping or to arrange handover. 

If this deadline is not met, the order may be automatically cancelled, and the buyer or renter refunded. 

Automatic reminders are sent before any final cancellation. 

4. DELIVERY AND RECEIPT

The buyer or renter must report any issue upon receipt (damaged package, missing item, etc.) via their user account within 48 hours of delivery. 

USwapX recommends taking photos as soon as the package is opened in case of any issue. 

5. RETURNS AND REFUNDS

Sales between individuals are not subject to the statutory right of withdrawal, in accordance with applicable regulations. No return or refund can be automatically demanded, except where: 
  • The received item does not match the description. 
  • The item is damaged or unusable, 
  • The seller or lessor agrees to a return as a commercial gesture. 
In such cases, the buyer must submit a request within 5 days of receipt, via their account.  If the request is accepted, the buyer must return the item at their own expense, unless otherwise agreed. A full or partial refund will be issued upon receipt of the returned item.   

6. SPECIAL CONDITIONS FOR RENTALS

A deposit may be required by USwapX at the time of booking. This deposit is temporarily held and will be released once the lessor confirms that the returned item is in the same condition as when delivered—clean, complete, and undamaged. In the event of a dispute or damage, all or part of the deposit may be retained.  For rentals: 
  • Any cancellation by the renter less than 48 hours before the scheduled pickup or shipment is non-refundable, except in exceptional circumstances (supporting documentation required). 
  • In case of non-return, damage, or loss of the item, the lessor has the right to claim compensation. 
 

7. ROLE OF USWAPX IN CASE OF DISPUTES

USwapX acts as an intermediary and may intervene in disputes reported via the platform to offer mediation. However, USwapX cannot be held responsible in case of disagreement between users.  If the dispute remains unresolved, the user may refer the matter to an independent mediator or bring it before the competent courts.
