TERMS AND CONDITIONS OF SALE AND USE OF USwapX
USwapX is an online platform facilitating exchanges between individuals for the sale, purchase, and rental of second-hand items, with an eco-responsible approach. By accessing the site or using its services, the user accepts these Terms and Conditions of Sale and Use (“TCSU”).
1. PURPOSE
These TCSU aim to define the rights and obligations of users when using the USwapX platform, whether they are sellers, lessors, buyers, or simple visitors.
2. ACCESS TO THE SERVICE
Access to the site is open to any adult or any minor under the responsibility of a legal guardian. A user account is required to publish, buy, rent, or search for items.
3. ROLE OF USwapX
USwapX acts as a technical intermediary. The platform enables matchmaking but is not a party to the sales or rental contracts between users. USwapX does not directly verify the items listed by sellers or lessors and does not guarantee their authenticity, origin, or compliance with the descriptions provided. Each user is responsible for exercising due diligence during transactions.
4.SERVICE OPERATION
Users can post advertisements for sale, rental, as well as requests for items they wish to acquire or rent. Other users may respond to these requests if they have the relevant items.
Transactions are carried out through the platform’s interface. Delivery, collection, or payment arrangements are set by the users themselves, unless they use the logistics service offered by USwapX.
5.USER OBLIGATIONS
Each user undertakes to:
· Provide accurate and verifiable information,
· Not post illegal or misleading content,
· Comply with applicable laws (consumer law, intellectual property, etc.),
· Not use the service for fraudulent or unauthorized commercial purposes,
· Not post counterfeit items.
Any breach of these obligations may result in the suspension or immediate termination of access to the service and the platform.
6. PRODUCTS AND QUALITY
Items must comply with the description and stated condition. The seller or lessor is solely responsible for the compliance of the items and for any disputes arising therefrom.
7. BUSINESS MODEL
USwapX may charge a commission on transactions, which is displayed before confirmation. Logistic fees may apply if the seller chooses a delivery service managed by USwapX.
8. PAYMENT AND SECURITY
Payments are secured via an external provider. USwapX does not store banking data. The amount is transferred to the seller/lessor according to the agreed terms.
9.RIGHT OF WITHDRAWAL AND DISPUTES
For sales between private individuals, the right of withdrawal does not apply.
In case of a dispute, USwapX may offer mediation, but cannot be held liable for its outcome.
10. ACCOUNTS AND SUSPENSION
USwapX reserves the right to suspend or delete an account in the event of a breach of these TCSU, proven fraud, or abusive behavior.
11. INTELLECTUAL PROPERTY
Content published by USwapX (text, logo, design) is protected. Any reproduction without prior authorization is prohibited.
12. PERSONAL DATA
Data collected is processed in accordance with the privacy policy available on the site. Users may exercise their rights by contacting: contact@uswapx.com.
13. AMENDMENTS TO THE TERMS
USwapX may amend these TCSU. Use of the site after publication of the new terms constitutes acceptance thereof.
14. GOVERNING LAW
These TCSU are governed by French or Belgian law, depending on the user’s location.
